I am British and my girlfriend is Chinese. She is here on a student visa. we plan to marry in the spring and she has applied for a certificate of approval. once this comes and we marry what do I have to do in order for her to stay here as my wife. what legal things etc??

Hi Robin

Once you're married, she'll need to apply for temporary leave to remain from the Home Office. This will grant her 2 years right to live and work in the UK.

If after 2 years you are still married and living together, she will be able to apply for permanent leave to remain. You'll be asked to provide LOTS of evidence that you've been living together over that time, so it's best to download the form now to see what is required and make sure she is on all the household bills, electoral register, etc. so that you'll have all that's required when the time comes.

After that, she will normally be eligible for citizenship. This is an separate step after receiving permanent leave. However, China does not allow dual citizenship...

Your best bet is to find all the forms and guides from the IND website, and read through them now. And be prepared to pay lots of money each time...

Hello

I have now married my Chinese girlfriend and she is my wife. She has applied for the 2 year visa and we are waiting for that to be processed. She has a old daughter still in China and I wanted to know what the legal rules were on bringing her her permanently. She is 15 and a dependent.

15 year old daughter... you broke up a marriage didn't you? Hardly making the situation any better... it's not like China needs less women there.

Bearing in mind the 1 child policy is in effect... does that mean her ex gets to have another child, if she gets sent over here? Just doesn't seem that fair on the bloke. Not that you care, you crafty old dodger.

hello

Actually her first husband left when the daughter was born 15 years ago. He wanted a son not a daughter and left, so I havent broken up the marriage as her father hasnt seen her since the day she was born.

with regard to the 1 child policy my wife has 3 sisters and 2 brothers

Im sorry but it's not that easy to apply for Indefinate Leave to Remain after just 2 years.
Firstly you must acquire an accredited ESOL level before you can apply for ILR. Couple that with the fact that you cannot enrol for 12 months as an overseas immigrant, and you will be lucky to get ILR until your 4th year.

You must apply for a Settlemrnt Visa for your wifes daughter.

Jeff, learn a little about China and the life their before you comment.
