14th February 2000 Ms Joe Veail and Mr Mark Kendal [Date] Dear Ms Veail and Mr Kendal, Re: Mr C.F. Chan CPS Reference number: 42000 I understand that on 18th February 2000 at Grimsby Crown Court, Judge Heath ordered the CPS to reduce the charge made against Mr C.F. Chan. Judge Heath also made his view clear that the appropriate charge, if any, must not be higher than Actual Bodily Harm. Mr Chan was under sustained attack from the three drunk white men for over 20 minutes during the incident on 5th September 1999. Mrs Chan and three young children who were in the kitchen witnessed the attack on Mr Chan. Mrs Chan had called the police twice during the attack but there was no sign of the police when the three attackers were trying to climb over the counter. The use of hot oil by Mr Chan was an act of defence to protect his young family. I am appalled that the police arrested and charged Mr Chan, took no action against the three drunk white men and instead used them as prosecution witnesses. I believe that the police should have breathalysed the three attackers and charged them for criminal damage to the takeaway and for public order offences. I write to ask you to drop all charges against Mr Chan and to investigate the offences committed by the three white men in this case. If the CPS continues its charge against Mr Chan, it will be sending out the message that it is alright to attack Chinese takeaways or restaurants, and that the law penalises race crime victims who attempt to defend themselves, their family and property.
